Privacy and contract management
Alternative methods of service delivery – outsourcing or contracting of information technology (IT) services, joint service delivery, cooperative ventures and partnerships – all involve additional considerations for organizations in meeting their privacy obligations. Under privacy legislation organizations remain responsible for personal information collected on their behalf by contracted parties, transferred to third parties for processing, or accessed and used by third parties pursuant to contractual or agency relationships. If a third party provider was sharing or selling the organization’s personal information to other parties, or using it for its own purposes, the organization would be found to be in non-compliance with privacy legislation.
Third party contracts
Contracts with third parties must clearly state the requirements for collecting, compiling, ensuring the accuracy of, protecting, using, accessing, disclosing, correcting and disposing of personal information imposed by privacy legislation.
